This one-hour CLE program will focus on recent trends and developing issues in consumer-fraud class actions. The speakers' presentations will be followed by an opportunity for questions. The following topics will be addressed:
- Class-Settlement Approval. Recent amendments to Federal Rule of Civil Procedure 23(e) and the U.S. Department of Justice's uptick in filing objections to consumer class settlements under the Class Action Fairness Act foretell increased scrutiny of proposed class-action settlements. The speakers will discuss these developments, as well as best practices going forward.
- Absent Uninjured Class Members. Courts have taken varied approaches to implications of absent uninjured class members. The speakers will discuss recent developments in the law and courts' views on this issue under the Rule 23 predominance framework, as a threshold standing issue, and under a combination of these paradigms.
- Online Consumer Complaints. In consumer-fraud class actions involving alleged product defects, do allegations of online consumer complaints suffice to demonstrate notice to a defendant of a defect and disclosure obligations, such that merely pleading their existence is enough to survive a motion-to-dismiss challenge? The speakers will discuss the developing law on this issue.
- Motions to Strike. Recent trends suggest that courts are increasingly receptive to early motions to strike class allegations where it is clear at the pleading stage that the requirements for a class action cannot be met. The speakers will discuss strategic considerations and procedural bases for motions to strike, as well as the Rule 23 requirements most susceptible to early attack.
This program has been approved for 1.00 hour of general credit by the State Bar of California and 1.00 hour of areas of professional practice credit (including transitional credit) by the New York State CLE Board. Jones Day is a State Bar of California MCLE approved provider, as well as an accredited provider in New York. Pennsylvania credit is not available for this program. Application for CLE credit in other states will be made as needed.
