Shay Dvoretzky recognized as a "Litigation Trailblazer" by the National Law Journal

July 2018

Issues & Appeals partner Shay Dvoretzky was profiled in the National Law Journal's 2018 Litigation Trailblazers special supplement, which recognizes lawyers who have made an impact in their sector through new types of strategies or innovative court cases.

Mr. Dvoretzky was featured for recent impact on the law in two areas: (1) curtailing abusive class actions by convincing the U.S. Court of Appeals for the DC Circuit to unanimously invalidate the FCC’s interpretation of the Telephone Consumer Protection Act (TCPA), which significantly changed the landscape of future TCPA class action cases; and (2) protecting clients' right to choose counsel by convincing California's Supreme Court (following the New York Court of Appeals' decision in a similar case that Mr. Dvoretzky won) to unanimously reject "unfinished business" claims by bankrupt law firms. The National Law Journal also noted Mr. Dvoretzky's win in the U.S. Supreme Court in NLRB v. SW General, which invalidated the Executive Branch's longstanding interpretation of the president's authority to appoint acting officials under the Federal Vacancies Reform Act.
