Jones Day's Intellectual Property Practice has been named a Practice Group of the Year for 2017 by Law360, which highlighted the Firm’s recent successes including a record $2.5 billion patent infringement federal jury award and a closely followed case before the U.S. Supreme Court in which the Firm argued against the partial-decision practice of the Patent Trial and Appeal Board (PTAB).
On behalf of Idenix Pharmaceuticals, LLC (Idenix), a subsidiary of Merck & Co., a Jones Day team won the largest patent infringement verdict in U.S. history. Following a nine-day trial and less than two hours of deliberation, a federal jury in Delaware awarded Idenix $2.54 billion against Gilead Sciences, Inc. in damages as compensation for infringing sales of sofosbuvir-based medicines through August 2016. The verdict was a landmark outcome in an industry that relies on patent protection to foster research on new medical treatments.
In the Supreme Court matter, on behalf of software developer SAS Institute Inc., the Firm challenged the PTAB’s practice to elect to institute inter partes review (IPR) proceedings on some, but not all, of the challenged claims, resulting in partial decisions. Such partial decisions result in fragmented litigation on patent invalidity. The Supreme Court’s decision could significantly impact how the PTAB conducts IPRs. While the PTAB maintained that its practice helps to streamline the review process and reduces litigation, Jones Day countered that this practice actually creates more litigation, according to Anthony M. Insogna, chair of the Firm’s global Intellectual Property Practice.
