Jones Day named Trial Practice Group of the Year by Law360

February 2018

Jones Day's Business & Tort Litigation Practice has been named a Practice Group of the Year for 2017 by Law360, which highlighted the Firm's recent successes, including a record $2.5 billion patent infringement federal jury award and a proven track record representing R.J. Reynolds through multiple Engle progeny trials. According to Law360, "What may solidify Jones Day's trial expertise in the years to come . . . is the experience constantly being accumulated by its attorneys — even as jury trials grow ever more rare."

On behalf of Idenix Pharmaceuticals, LLC (Idenix), a subsidiary of Merck & Co., a Jones Day team won the largest patent infringement verdict in U.S. history. The verdict was a landmark outcome in an industry that relies on patent protection to foster research on new medical treatments. Partner Stephanie Parker, a Law360 2017 Trials MVP, served as lead trial lawyer on this matter, coordinating with the Firm's intellectual property and product liability teams.

In the profile, Business & Tort Litigation Leader John Majoras said the collaboration and teamwork required for this case "epitomizes what we do from a litigation standpoint at Jones Day, and how we go after matters, how we staff matters, how we respond to client requests and ultimately how well we do in the courtroom." Following a nine-day trial and less than two hours of deliberation, a federal jury in Delaware awarded Idenix $2.54 billion in damages against Gilead Sciences, Inc., as compensation for infringing sales of sofosbuvir-based medicines through August 2016.

The Law360 profile also noted that Jones Day has represented R.J. Reynolds in approximately 140 Engle progeny trials involving smokers' health risks in Florida. Many of these cases include multimillion-dollar claims. Since October 2016 alone, the Firm has represented Reynolds in 19 such trials.
