Multi-state charter school company successfully defeats foreign government's 1782 application

Jones Day successfully defended a multi-state charter school company against an application brought by the Republic of Turkey that sought extensive discovery pursuant to 28 U.S.C. § 1782. The application, which was premised on claims that the company's U.S. activities had potentially violated Turkish money laundering laws, raised serious rule of law concerns and unique questions about a foreign sovereign's ability to conduct an investigation in the United States through a civil discovery statute in lieu of an established MLAT procedure. After briefing and argument on the issue, the district judge denied the 1782 application in full.
